Return to the Legal Process menu The SheriffThe Sheriff is a Court Officer entitled to seize goods from the debtor which may then be sold to realise funds for the discharge of the debt. This can take quite some time, and in many cases the Judgement will be returned because the Sheriff is of the opinion that the debtor has no goods which can be seized. In the case of a Limited Company the Sheriff may be the only realistic option after registration. We also lodge Judgements with the Sheriff for low value accounts. If you are sure that the debtor (and not somebody else) owns something valuable, for example a car, you can ask the Sheriff to seize it. The Sheriff can also enter into an instalment arrangement with a debtor,
which may be the best way of getting paid over a reasonable period of
time. |
